1. Acceptance of Terms
By accessing or using DoubleQuote (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.
2. Description of Service
DoubleQuote is a price transparency and comparison platform for home services. The Platform provides informational cost estimates based on aggregated, anonymized data submitted by users and other sources.
DoubleQuote is not:
- A licensed contractor, home inspector, or professional appraiser.
- A contractor marketplace, referral service, or brokerage.
- A provider of professional, financial, or legal advice.
- A guarantor of any contractor's licensing, insurance, quality, or performance.
Any agreement you enter into with a service provider found via information on this Platform is strictly between you and that third party. DoubleQuote is not a party to any such agreement. For pricing-specific disclaimers, see our Price Accuracy & Liability Disclaimer.
3. Eligibility
You must be at least 13 years of age to use DoubleQuote. By creating an account, you represent that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.
4. Account Responsibilities
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You agree to provide accurate and complete information when creating your account.
- Account creation is facilitated through third-party OAuth providers (e.g., Google, Apple, Meta, X). You are subject to each provider's own terms of service.
- DoubleQuote reserves the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or unlawful activity.
5. User-Submitted Content
When you submit quotes, pricing data, uploaded files, or other content to DoubleQuote:
- You retain ownership of the content you submit.
- You grant DoubleQuote a non-exclusive, royalty-free, worldwide license to use, display, aggregate, and analyze your submissions to operate and improve the Platform.
- You represent that you have the right to share any content you submit and that it does not violate any third party's rights.
- Submitted data may be aggregated and anonymized for use in pricing estimates visible to other users.
- Uploaded files (e.g., contractor quotes) may be processed using automated tools, including AI-based classification, to categorize and extract pricing information.
6. Acceptable Use
You agree not to:
- Submit false, misleading, or fabricated pricing data.
- Use the Platform to harass, defame, or harm any individual or business.
- Scrape, crawl, or use automated means to extract data from the Platform without prior written consent.
- Attempt to gain unauthorized access to the Platform, other user accounts, or our systems.
- Use the Platform for any unlawful purpose.
7. Donations and Tips
The Platform may offer you the option to leave an optional tip or donation when submitting a quote request. By making a donation, you acknowledge and agree that:
- Donations are entirely voluntary and are not required to use any feature of the Platform.
- Donations are non-refundable once processed.
- Donations are not payments for services rendered. A donation does not create any contractual obligation for DoubleQuote to deliver specific results, quotes, or outcomes.
- DoubleQuote makes no guarantee that a quote request — whether accompanied by a donation or not — will result in finding quotes for your requested service.
8. Intellectual Property
The DoubleQuote name, logo, design, and all original content on the Platform are the property of DoubleQuote and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without our prior written consent.
9. Disclaimer of Warranties
The Platform is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. 10. Limitation of Liability
To the maximum extent permitted by law, DoubleQuote and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of or inability to use the Platform.
11. Indemnification
You agree to indemnify, defend, and hold harmless DoubleQuote and its officers, directors, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third party's rights, including intellectual property or privacy rights; or (d) any content you submit to the Platform, including pricing data that is false, misleading, or defamatory.
12. Dispute Resolution
Any dispute arising from these Terms or your use of the Platform shall be resolved as follows:
- Informal Resolution: You agree to first attempt to resolve any dispute informally by contacting us. We will try to resolve the dispute within 30 days.
- Binding Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration administered under the rules of the American Arbitration Association (AAA), conducted in the user's state of residence.
- Opt-Out: You may opt out of binding arbitration within 30 days of creating your account by sending written notice to legal@doublequote.com with the subject line “Arbitration Opt-Out.” If you opt out, disputes will be resolved in a court of competent jurisdiction in your state of residence.
- Class Action Waiver: You agree to resolve disputes on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration.
13. Modifications to Terms
DoubleQuote reserves the right to update these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
14. Governing Law
These Terms are governed by applicable federal law and the laws of the state in which the user resides, without regard to conflict of law principles. DoubleQuote operates across all 50 U.S. states.
15. Section 230 Safe Harbor
DoubleQuote is an interactive computer service that hosts and displays content provided by third-party users, including pricing data, quotes, and service descriptions. In accordance with Section 230 of the Communications Decency Act (47 U.S.C. § 230):
- DoubleQuote shall not be treated as the publisher or speaker of any information provided by its users or other third-party content providers.
- DoubleQuote reserves the right, in good faith, to restrict access to or remove any user-submitted content that it considers to be inaccurate, misleading, fraudulent, obscene, or otherwise objectionable, without incurring liability for such moderation actions.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy and Price Accuracy & Liability Disclaimer, constitute the entire agreement between you and DoubleQuote regarding your use of the Platform. They supersede all prior agreements, representations, and understandings, whether oral or written.
18. Force Majeure
DoubleQuote shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure outages, pandemics, cyberattacks, or third-party service failures.
